1. Introduction

Al-Nazm Al-‘Umraniyyah For Trading Company (NUTC) is committed to respecting your privacy and protecting your information (i.e., any information that can identify you as an individual or corporate entity). Hence, this Privacy Policy explains how we handle and protect your information.

2. Information we collect

NUTC collects personal data in the context of conducting commercial activities and providing services. Additionally, we gather your data in specific areas of the platform when you register and/or create a user profile and/or subscribe to receive our newsletters and alerts. The types of personal data collected by us may vary. You may provide us with your name, postal address, email address, telephone number, fax number, and other information necessary in order to provide the services.

We will always strive to take the necessary care to ensure that the third party has informed you in advance of its use and our use of this data without any liability to NUTC in case the third party did not comply with the privacy policies.

3. The use of information

Your data is used to fulfill your needs in obtaining the services, customize the content we display or you receive on the platform, evaluate and improve our services, send you newsletters and alerts, analyze the performance and operation of the platform, prevent fraud, enforce our terms and conditions of use, and comply with all applicable laws and regulations in KSA. We may keep any personal data on file and use it to communicate and outreach to you.

Our service providers and we may also use cookies and other tracking technologies, including web beacons, to administer BuildMart, deliver our services, and gather analytics on how it is used.

4. The use of information collected Via mobile devices

Regarding mobile applications, NUTC may use third-party service providers to analyze user activity to fix errors in mobile applications, monitor their use, and improve their performance. For example, NUTC receives reports on specific usage and browsing patterns of mobile applications that include information about the type of device used, the services that have been used, and other actions that occur through our applications. We also receive reports of some errors occurring in mobile apps.

5. Statutory reliance on our collection and orocessing of your personal information

Your data is collected and processed for the above purposes in accordance with the following:

    • Our legitimate interests in promoting and protecting the platform, building and maintaining relationships, and providing our services as required.
    • Your consent, by creating a user profile, subscribing to packages, or subscribing to our newsletters or alerts, you consent to our use of personal information provided by you.
    • Comply with the laws and regulations in force in KSA.
6. Disclosure of personal data

We may share your data with third-party service providers who provide services and functions on our behalf to support your interaction with us, for example, to process data, conduct surveys or contests, or communicate with you.

Furthermore, we may disclose or transfer your data in the event of a reorganization, merger, sale, participation, waiver, transfer, or disposition of all or part of our business.

Moreover, we are committed not to disclose personal data in the cases defined in paragraphs (1), (2), and (5) when the disclosure is characterized by any of the following:

  1. It threatens security, harms the Kingdom's reputation, or conflicts with its interests.
  2. It affects the kingdom's relations with another country.
  3. It prevents the detection of a crime, affects the rights of an accused to a fair trial, or affects the integrity of existing criminal proceedings.
  4. It endangers the safety of an individual(s).
  5. It entails violating the privacy of an individual other than the owner of personal data as determined by KSA regulations.
  6. It conflicts with a defective or legally unqualified.
  7. It violates legally-established professional obligations.
  8. It involves a breach of an obligation, a procedure or a judicial judgment.
  9. It reveals a secret source of information that the public interest must not disclose.
7. Links to third-party websites

NUTC may provide links to third-party websites or information as a service to our users. By clicking on these links, you'll be taken to pages outside the platform. These links do not constitute or express support, sponsorship, or recommendation by us of the third party to which the links lead, their website, or the information contained therein. We will have no responsibility or liability in connection with your use of them. Such use is subject to the terms of use and privacy policies applicable to such sites.

8. Security and protection of information

NUTC has taken reasonable and necessary care for technological and operational security to protect personal data from loss, misuse, alteration, or destruction. Access to personal data is limited to its employees and authorized third-party service providers, who must keep it confidential. Despite these precautions, NUTC cannot guarantee that unauthorized persons will not access your information. We will notify you immediately when we become aware of any leak, corruption, or unauthorized access to personal data.

9. Data retention

The Platform retains personal data as necessary during the working relationship and service provision. Furthermore, we may keep personal data for longer than the duration of a working relationship if necessary to protect against legal claims, use the data for analysis, historical record-keeping, or comply with information management policies. In the event you request us to remove your data, NUTC will make reasonable attempts to remove it in its entirety. 10. Your rights

You have the right to request access to the personal data we have collected about you for the purposes of reviewing, modifying, or deleting. You also have the right to request a copy of the personal data we have collected about you and to request the correction of any errors. Moreover, to help protect your privacy and security, we will take reasonable steps to verify your identity, such as requesting a password or user ID, before allowing you to access your data. We undertake to make a reasonable effort to promptly verify, comply with, or not comply with your requests according to applicable regulations. The various regulations may prevent us from giving you access to your data or complying with your request entirely depending on the circumstances and the request made. For example, if providing your information could reveal another person's identity. We reserve the right to charge appropriate fees to fulfill your request where the applicable regulation allows and/or rejects the request if it is based on improper, and/or exaggerated or otherwise unacceptable, or illegal under the applicable regulation.

11. Consent to updates and changes to the privacy policy

Using BuildMart, you agree that we can collect, use, and store your information as described in this Privacy Policy and elsewhere on the platform. Additionally, we reserve the right to make changes to this Privacy Policy from time to time, and you will be notified of any such changes. Suppose we make fundamental changes to this privacy policy that increase our rights to use the personal data we have previously collected about you. In that case, we will seek your approval either via a message to your registered email address or by posting information on changes in a visible place on the platform.

12. Applicable laws / Dispute resolution

The privacy policy is subject to the laws and regulations of KSA. These are the laws adopted in settling any local or international disputes or claims. If any disagreement arises with respect to the execution or interpretation of the terms of this policy, we will do our best to resolve it amicably. In case this is not possible, the dispute shall be directed to Riyadh's courts, which are competent courts to settle all disputes, claims, and disagreements arising from the violation, termination, execution, interpretation, or validity of this policy or due to the use of the platform.

13. Language

The Arabic language is the official and approved language in drafting the terms of service agreement, and it is the only original text. There may be different copies of these terms and conditions translated into other languages, which cannot be relied on to extract the rights and duties contained therein if there is any conflict between the Arabic and the translation.
